Introduction

These Membership Terms and Conditions (Terms) are a legally binding agreement between you (Member) and iFix Mildura Pty Ltd ABN 78 517 705 249 of 7/840 Fifteenth Street, Mildura VIC 3500 (iFix Mildura, we, us, our).

By completing the membership signup process, ticking the agreement checkbox, and making payment, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

If you do not agree to these Terms in their entirety, you must not purchase or use an iFix Mildura membership.

These Terms are governed by the laws of Victoria, Australia and are subject to the Australian Consumer Law (ACL) as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

1. Definitions

1.1 Activation Date means the date 30 days after the Member's initial payment, from which repair discounts and accessory entitlements become active.

1.2 Benefits means the discounts, entitlements, and prize draw entries available to Members under their chosen Tier.

1.3 Billing Cycle means the frequency of recurring charges: monthly, six-monthly, or annual.

1.4 Draw Entries means the weighted entries allocated to a Member for participation in the Monthly Prize Draw.

1.5 Entitlement means a periodic benefit such as a free screen protector, discounted cable, or free accessory allocated to a Member based on their Tier.

1.6 Member means a person who has completed the signup process and holds an active membership.

1.7 Member Portal means the online self-service portal accessible at ifixmildura.com.au/membership.

1.8 Monthly Prize Draw means the monthly draw conducted by iFix Mildura in which eligible Members may win a prize.

1.9 Registered Device means a device registered by a Member to their membership account by serial number.

1.10 Tier means the membership level chosen by the Member: iFix Club, iFix Device, iFix VIP, or iFix Family.

2. Eligibility

2.1 Age requirement. You must be 18 years of age or older to purchase or hold an iFix Mildura membership. By joining you confirm you are at least 18 years old.

2.2 Misrepresentation of age. If you misrepresent your age to obtain a membership, iFix Mildura reserves the right to terminate your membership immediately without refund. Such misrepresentation constitutes fraud and shifts full legal liability to you.

2.3 One membership per person. Each individual may hold only one active membership at any time. Multiple accounts held by the same person will be terminated and any benefits obtained will be considered void.

2.4 Australian residents. Membership is open to all Australian residents. You do not need to be located in Mildura to join. Repair discounts apply to mail-in repairs sent to our Mildura service centre from anywhere in Australia, as well as in-store repairs for local customers. Prize winners located outside of Mildura may arrange postage of their prize to any Australian address at no cost to the winner.

2.5 Right to refuse. iFix Mildura reserves the right to refuse membership to any person at its sole and absolute discretion, including where a person has previously been blacklisted or terminated for misconduct.

2.6 Capacity. By agreeing to these Terms you warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

3. Membership Tiers and Pricing

3.1 Four paid tiers are available:

  • iFix Club — $3.99 per month
  • iFix Device — $7.99 per month
  • iFix VIP — $14.99 per month
  • iFix Family — $34.99 per month

3.2 Billing options:

  • Monthly — charged every 30 days
  • Six-monthly — pay for 5 months, receive 6 months access
  • Annual — pay for 10 months, receive 12 months access

3.3 All prices are in Australian dollars and include GST where applicable.

3.4 Price changes. iFix Mildura may change membership pricing at any time with not less than 30 days written notice to the Member's registered email address. If you do not accept the new pricing you may cancel before the change takes effect. Continued use after the notice period constitutes acceptance of the new pricing.

3.5 Promotional pricing. Promotional or introductory pricing offered at signup may revert to standard pricing at the end of the promotional period. This will be clearly disclosed at the time of signup.

3.6 Tier changes. Members may upgrade or downgrade their Tier at any time from the Member Portal. Upgrades take effect immediately. Downgrades take effect at the next billing date.

4. Payment and Billing

4.1 Payment processing. All payments are processed securely by Stripe Technology Europe Limited (Stripe). iFix Mildura does not collect, store, or have access to your full payment card details. By providing payment details you also agree to Stripe's terms of service.

4.2 Automatic renewal. Your membership automatically renews at the end of each Billing Cycle unless cancelled before the renewal date. By signing up you authorise iFix Mildura to charge your payment method on a recurring basis.

4.3 Failed payments. If a payment fails iFix Mildura will:

  • Day 1 — notify you by email that payment has failed. Benefits remain active.
  • Day 3 — suspend your Benefits if payment remains outstanding. You will be notified by email.
  • Day 7 — send a final warning email.
  • Day 8 — cancel your membership and Stripe subscription if payment has not been received.

4.4 Reactivation. If your membership is cancelled due to failed payment you may rejoin as a new member. Prior entitlements, draw entries, and milestones will not be reinstated.

4.5 Disputed charges. If you believe a charge is incorrect contact iFix Mildura at repairs@ifixmildura.com.au before initiating a chargeback with your bank. Initiating an unjustified chargeback may result in termination of your membership.

4.6 GST. iFix Mildura is registered for GST. Tax invoices are available on request.

5. Cancellation and Refunds

5.1 Right to cancel. You may cancel your membership at any time from the Member Portal at ifixmildura.com.au/membership or by contacting iFix Mildura directly.

5.2 No lock-in. There is no minimum term or lock-in period. You may cancel at any time without penalty.

5.3 No refunds on current period. No refund is issued for the current billing period following cancellation. Your Benefits continue until the end of the paid period.

5.4 Prepaid plans. No refund is issued for any unused portion of a prepaid six-monthly or annual plan following voluntary cancellation by the Member.

5.5 Draw entries on cancellation. All prize draw entries are forfeited immediately upon cancellation. No compensation is provided for forfeited entries.

5.6 Unused entitlements. Unused accessory entitlements at the time of cancellation are forfeited with no compensation.

5.7 Termination by iFix Mildura. iFix Mildura may terminate your membership immediately and without refund for:

  • Abuse or fraudulent use of Benefits
  • Providing false or misleading information at signup or during membership
  • Misrepresentation of age
  • Registering devices you do not own or have permission to register
  • Creating multiple accounts
  • Sharing membership benefits with non-members
  • Behaviour that is threatening, abusive, or harmful to iFix Mildura staff or other members
  • Any activity that iFix Mildura reasonably determines constitutes abuse of the membership program

5.8 Goodwill termination. If iFix Mildura terminates your membership for reasons not caused by your misconduct, a pro-rata refund of any unused prepaid period will be issued within 14 days.

5.9 Australian Consumer Law. Nothing in these Terms limits or excludes any guarantee, right, or remedy you have under the ACL that cannot be excluded by law.

6. Activation Period and Benefits

6.1 Activation period. Repair discounts and accessory entitlements activate 30 days after your initial payment (Activation Date).

6.2 Immediate benefits. The following are available immediately from signup:

  • Monthly Prize Draw entries
  • Referral code and referral bonuses
  • Access to the Member Portal

6.3 Benefit changes. iFix Mildura may modify, add, or remove Benefits with 30 days written notice. Where a benefit is removed without equivalent replacement, Members may cancel within 30 days for a pro-rata refund of prepaid amounts.

6.4 Stock availability. Some benefits depend on stock availability. iFix Mildura will use reasonable endeavours to ensure availability but does not guarantee all benefits will be available at all times.

7. Repair Discounts

7.1 Discount rates and caps by Tier:

  • iFix Club: 10% discount, capped at $25.00 per repair
  • iFix Device: 15% discount, capped at $40.00 per repair
  • iFix VIP: 20% discount, capped at $55.00 per repair
  • iFix Family: 25% discount, capped at $70.00 per repair

7.2 Annual repair limits per Tier:

  • iFix Club: maximum 2 per year
  • iFix Device: maximum 3 per year
  • iFix VIP: maximum 4 per year
  • iFix Family: maximum 5 per year

7.3 First 90 days restriction. During the first 90 days of membership a maximum of one discounted repair applies regardless of Tier.

7.4 Device requirement. Discounts apply only to Registered Devices. The device being repaired must be registered to your account at the time of booking.

7.5 Cannot be combined. Membership discounts cannot be combined with promotional codes or other offers. The higher value discount applies.

7.6 Scope of discount. Discounts apply to standard labour and parts. Premium parts may be excluded and will be disclosed at time of quote.

7.7 Bookings required. You must identify yourself as a Member at time of booking and provide your membership number. Discounts cannot be applied retrospectively.

8. Device Registration

8.1 Serial number. Device registration uses serial number as the primary identifier. IMEI is optional and for phones only.

8.2 Device limits by Tier:

  • iFix Club: 1 device
  • iFix Device: 1 device
  • iFix VIP: 1 device
  • iFix Family: up to 4 devices

8.3 Device lock. Each registered device is locked for 90 days from registration. During the lock period the device cannot be swapped without admin approval.

8.4 Early swap. Swap requests may be submitted through the Member Portal and are granted at iFix Mildura sole discretion. iFix Mildura will act reasonably in considering requests.

8.5 Duplicate detection. If a serial number is already registered on another active account, registration will be blocked and an alert raised for admin review.

8.6 Ownership. By registering a device you warrant that you own the device or have permission from the owner to register it.

9. Accessory Entitlements

9.1 Entitlement schedule by Tier:

iFix Club:

  • No accessory entitlements.

iFix Device (per quarter):

  • 1 free screen protector
  • 1 cable or charger at 50% off
  • 1 case at 50% off

iFix VIP:

  • 1 free screen protector per month
  • 2 cables or chargers at 50% off per quarter
  • 1 case at 50% off per quarter
  • 1 free accessory up to $30 per quarter

iFix Family:

  • 1 free screen protector per registered device per month
  • 3 cables or chargers at 50% off per quarter
  • 2 cases at 50% off per quarter
  • 1 free accessory up to $30 per quarter

9.2 No carry-over. Unused entitlements do not carry over and have no cash value.

9.3 Activation required. Accessory entitlements are only available after the Activation Date.

9.4 Redemption. Entitlements are redeemable in-store or through the Member Portal booking system.

9.5 Screen protectors. Free screen protector entitlements apply to standard clear tempered glass protectors. Premium protectors may require a co-payment.

9.6 Free accessory cap. The free accessory covers items up to $30.00. Items above $30.00 require a top-up for the difference.

9.7 Stock availability. Entitlements are subject to stock. Where an item is unavailable iFix Mildura will offer a suitable alternative.

9.8 Screen protector quality and installation. Screen protectors provided as part of membership entitlements are standard tempered glass protectors. iFix Mildura does not warrant that screen protectors will be compatible with all device cases or accessories. Screen protector installation is performed by iFix Mildura staff in store and is subject to device condition at time of fitting. iFix Mildura reserves the right to decline installation where device condition makes fitting unsuitable or unsafe.

10. Monthly Prize Draw

10.1 Nature of draw. The Monthly Prize Draw is a free bonus benefit of membership. Members do not pay specifically to enter the draw. The draw is not a lottery or trade promotion lottery requiring a permit under the Gambling Regulation Act 2003 (Vic) or any other Victorian legislation.

10.2 Entry allocation by Tier:

  • iFix Club: 1 entry per month
  • iFix Device: 5 entries per month
  • iFix VIP: 10 entries per month
  • iFix Family: 20 entries per month

10.3 Immediate entries. Draw entries are allocated immediately upon membership activation. No activation period applies to draw entries.

10.4 Referral bonus entries. When a referred friend's membership activates, both the referrer and friend receive 2 additional draw entries for that calendar month only.

10.5 Monthly reset. Draw entries reset on the 1st of each calendar month. Entries do not carry over.

10.6 Eligibility. To be eligible a Member must:

  • Have an active membership at time of draw
  • Not be a current or former employee, contractor, or owner of iFix Mildura
  • Not be an immediate family member of any iFix Mildura employee, contractor, or owner
  • Not be blacklisted from participation

10.7 Draw conduct. The winner is selected by weighted random selection using a cryptographically secure algorithm. The result is final and binding.

10.8 Winner notification. Winners are notified by email within 24 hours. Two contact attempts will be made over 30 days.

10.9 Prize claim. Winners have 30 calendar days to claim their prize:

  • In person at 7/840 Fifteenth Street Mildura VIC 3500 with photo ID
  • By post with valid Australian delivery address

10.10 Unclaimed prizes. If unclaimed after 30 days despite two contact attempts, iFix Mildura will conduct a redraw. The original winner forfeits all claim.

10.11 Prize substitution. iFix Mildura may substitute an advertised prize with an alternative of equal or greater retail value if the original becomes unavailable.

10.12 No cash alternative. Prizes cannot be exchanged for cash or credit under any circumstances.

10.13 Prize records. Records are retained for a minimum of 3 years in accordance with Victorian requirements.

10.14 Publicity consent. Winners may be asked to consent to publication of their first name, last name initial, and suburb (e.g. Sarah W. from Mildura). Consent is entirely voluntary. The prize is not conditional on publicity consent.

10.15 Tax. iFix Mildura makes no representation regarding tax implications of receiving a prize. Winners are responsible for their own tax advice.

10.16 Draw integrity. Any Member found to have manipulated or attempted to manipulate the draw will be immediately terminated and blacklisted.

10.17 Prize procurement and brand disclaimer. All prizes offered in the iFix Mildura Monthly Prize Draw are purchased independently by iFix Mildura Pty Ltd using its own funds. Prize draws are not affiliated with, endorsed by, sponsored by, or associated with any prize manufacturer, retailer, or brand including but not limited to Apple Inc, Samsung Electronics, Sony Interactive Entertainment, Microsoft Corporation, Nintendo, Hisense, JB Hi-Fi Group, or BP Australia Pty Ltd. All brand names and product names are trademarks of their respective owners and are used solely for descriptive purposes to identify the prize offered.

10.18 Prize images disclaimer. Product images used to represent monthly prizes are for illustrative purposes only and sourced from publicly available marketing materials. Actual prize delivered may vary slightly in colour, configuration, or packaging from the image shown but will be of equal or greater retail value. iFix Mildura makes no representation that prize images are current or reflect the exact item to be delivered.

10.19 Winner age requirement. Winners must be 18 years of age or older. A prize cannot be claimed by anyone under 18. iFix Mildura reserves the right to request proof of age before releasing any prize. If satisfactory proof cannot be provided within 14 days of winner notification iFix Mildura reserves the right to conduct a redraw.

10.20 Draw disputes. The decision of iFix Mildura regarding the conduct of the draw and the identity of the winner is final and binding in all respects. No correspondence will be entered into regarding draw results or winner selection. The draw algorithm is cryptographically secure and independently verifiable by iFix Mildura. In the event of any dispute iFix Mildura's decision is final.

10.21 Winner verification. Winners must provide valid Australian government issued photo identification before receiving their prize. Acceptable identification includes a current driver's licence or Australian passport. iFix Mildura reserves the right to verify the identity of any winner and to disqualify any winner who cannot provide satisfactory identification within 14 days of being notified or who is found to have breached these Terms in any way. A disqualified winner forfeits all claim to the prize and a redraw will be conducted.

10.22 Draw postponement. iFix Mildura reserves the right to postpone, suspend, or cancel a monthly draw in circumstances beyond its reasonable control including but not limited to natural disasters, government action, pandemic, power outages, or critical technical failures. In such circumstances iFix Mildura will use reasonable endeavours to conduct a rescheduled draw as soon as practicable and will notify all affected members by email within 48 hours of the decision to postpone or cancel. Where a draw is cancelled and cannot be rescheduled within 30 days iFix Mildura will offer an alternative prize draw of equivalent value or a prize credit to affected members at its sole discretion.

10.23 In-store spend entries. Active iFix VIP and iFix Family members earn one (1) promotional entry into The iFix Annual Grand Giveaway for every AUD $5 spent at iFix Mildura's physical retail location, calculated on the post-discount, GST-inclusive transaction total. In-store spend entries are not available to iFix Club or iFix Device members. Entries are credited after the transaction is reconciled and may take up to 48 hours to appear in a Member's account.

10.24 Annual Grand Giveaway eligibility. The iFix Annual Grand Giveaway is an end-of-year prize draw open only to Members holding an active iFix VIP or iFix Family membership at the time of the draw. Members whose membership is cancelled, paused, downgraded to iFix Club or iFix Device, or otherwise inactive at the time of the draw are not eligible to win and forfeit any accumulated entries.

10.25 Entry forfeiture on change of status. Where a Member cancels, pauses, or downgrades their membership at any time during the year, all accumulated Annual Grand Giveaway entries are immediately forfeited and reset to zero. Entries are not reinstated if the Member subsequently rejoins or upgrades.

10.26 Annual reset. All Annual Grand Giveaway entries reset to zero on 1 January each calendar year. Entries do not roll over between years. Staying active and continuing to spend in store throughout the year is the only way to accumulate and protect entries.

10.27 Grand prize disclosure. The Annual Grand Giveaway grand prize will be revealed at a date and in a manner determined by iFix Mildura at its sole and absolute discretion, typically closer to the end of the calendar year. iFix Mildura makes no representation as to the nature, value, or timing of the grand prize prior to its public announcement and reserves the right to substitute the prize with an alternative of equal or greater retail value.

10.28 Winner selection. The Annual Grand Giveaway winner is selected by a cryptographically secure weighted random draw, where each Member's chance of winning is proportional to the number of promotional entries they have accumulated during the year. Clauses 10.6 to 10.21 of these Terms apply to the Annual Grand Giveaway in the same manner as they apply to the Monthly Prize Draw, with references to the Monthly Prize Draw to be read as references to the Annual Grand Giveaway.

10.29 Entry calculation basis. Promotional entries are calculated on the final transaction amount as recorded by iFix Mildura's point-of-sale system, inclusive of any member discounts, promotional codes, or price reductions applied at the time of purchase. The pre-discount value of goods or services is not used for entry calculation purposes.

10.30 Eligible purchases. Promotional entries are awarded for eligible in-store purchases including repairs, accessories, parts, and services processed through iFix Mildura's point-of-sale system. The purchase of pre-owned or refurbished devices, whether in-store or online, is excluded from promotional entry calculations. This exclusion applies to ensure the fairness of the program for members who regularly visit iFix Mildura for repairs and accessory purchases.

11. Referral Program

11.1 Every Member receives a unique referral code upon signup.

11.2 When a referred friend's membership activates, both parties receive 2 additional draw entries for that calendar month.

11.3 Referral bonuses are for the month of activation only and do not carry over.

11.4 Self-referral is prohibited and will result in termination of both accounts without refund.

11.5 Referral bonuses are draw entries only and have no cash value.

12. Membership Pause

12.1 Members may pause membership for up to 3 months per calendar year.

12.2 During a pause:

  • Billing is suspended
  • All Benefits including draw entries are suspended
  • Milestone anniversary periods are paused
  • Device lock periods continue

12.3 Membership resumes automatically at the end of the pause period.

13. Fair Use Policy

13.1 Membership benefits are for personal use only. Commercial use or on-selling of benefits is strictly prohibited.

13.2 Patterns that may indicate abuse include:

  • Joining to use a repair discount then cancelling immediately
  • Repeatedly cancelling and rejoining to exploit discounts
  • Registering devices belonging to non-members
  • Attempting to redeem more entitlements than allocated
  • Creating multiple accounts to accumulate draw entries

13.3 Where abuse is suspected iFix Mildura may suspend benefits pending investigation. The Member will be notified and given opportunity to respond.

13.4 Members found to have abused the program will be terminated without refund and may be blacklisted from future membership.

14. Intellectual Property

14.1 All content on the iFix Mildura website and member portal is the property of iFix Mildura Pty Ltd or its licensors.

14.2 Members are granted a limited non-exclusive licence to use the Member Portal for personal membership management only.

14.3 Nothing in these Terms transfers any intellectual property rights to the Member.

15. Privacy and Data

15.1 iFix Mildura collects your name, email, phone number, device details, and payment information to administer your membership.

15.2 Your information is used to:

  • Manage your membership account
  • Process payments via Stripe
  • Send transactional and promotional communications
  • Administer the Monthly Prize Draw
  • Comply with legal obligations

15.3 iFix Mildura does not sell your personal information to third parties.

15.4 Payment card details are processed by Stripe and not stored by iFix Mildura.

15.5 iFix Mildura handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

15.6 You have the right to access and correct your personal information by contacting repairs@ifixmildura.com.au.

16. Communications

16.1 By joining you consent to receive transactional emails including welcome, payment receipts, payment failure notices, activation reminders, draw results, and account notices. These cannot be unsubscribed while your membership is active.

16.2 You may unsubscribe from promotional emails at any time using the unsubscribe link in any email.

16.3 iFix Mildura complies with the Spam Act 2003 (Cth).

17. Limitation of Liability

17.1 To the maximum extent permitted by law iFix Mildura excludes liability for:

  • Indirect, incidental, special, or consequential loss
  • Loss of profits or business opportunity
  • Loss of benefits due to technical failure beyond iFix Mildura reasonable control
  • Service interruption due to force majeure including natural disasters, pandemic, power outages, or government action

17.2 iFix Mildura total liability for any claim is limited to the total amount paid by you to iFix Mildura in the 3 months preceding the claim.

17.3 Nothing in this Section excludes any right or remedy under the ACL that cannot lawfully be excluded.

18. Dispute Resolution

18.1 Contact first. If you have a dispute you must first contact iFix Mildura at repairs@ifixmildura.com.au or 0427 507 888 and allow 14 days to resolve the matter.

18.2 Consumer Affairs Victoria. If unresolved you may contact Consumer Affairs Victoria at consumer.vic.gov.au or 1300 55 81 81.

18.3 ACCC. You may also contact the Australian Competition and Consumer Commission at accc.gov.au.

18.4 Governing law. These Terms are governed by the laws of Victoria. Any legal proceedings must be brought in the courts of Victoria.

19. General Provisions

19.1 Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and iFix Mildura regarding your membership.

19.2 Severability. If any provision is found invalid or unenforceable it will be severed and the remaining Terms continue in full force.

19.3 Waiver. Failure to enforce any provision does not constitute a waiver.

19.4 Assignment. iFix Mildura may assign its rights to a successor business. You may not assign your membership to another person.

19.5 Notices. Notices from iFix Mildura will be sent to your registered email. Notices to iFix Mildura must be sent to repairs@ifixmildura.com.au.

19.6 Updates. Material changes will be notified by email with at least 30 days notice. The current Terms are always available at ifixmildura.com.au/membership/terms.
